Why Is Commerce Control List Classification Important?

Commerce Control List Classification is a guideline for transactions to qualify whether commodities are for export.

The agency requires the following conditions for a transaction shall decide whether allowed for export: 1) the ECCN in the object, 2) where it goes, 3) the end-user. While most commercial exports in the U.S. are not permitted, a proper definition of the commodity is the first step in this process.

Subject for jurisdiction

If the object is subject to the jurisdiction of the U.S. Department of Commerce, you must then decide whether your object has a particular Export Control Classification Number (ECCN) found on the Commerce Control List (CCL). Moreover, they designate products not specified under the CCL as EAR99 according to the Export Administration Regulations (EAR)

Strategies for assessing the product’s Export Control Classification Number (ECCN).

Go to the source. Commerce Control.

Contact the manufacturer, creator, or manufacturer of the commodity you export. After this, check if their commodity has been graded and will send ECCN to you. In the past, they would usually have the ECCN, if they exported the products. Remember ECCNs will vary over time and update the ECCN to make sure you agree.

Self-classification. List Classification

You need professional knowledge of the object to carry out a self-classification. The CCL layout and design must be familiar to you. They divide the CCL into ten categories, represented by the first digit of the ECCN. They split each of the 10 areas into five product lines, described by the second digit of the ECCN. Define the classification and the product. Furthermore, it’s one of the following particular ECCNs that will fit the specific characteristics and features of your product.

The Commerce Control List Index is used to search the CCL. Start by searching the CCL index for your piece. Further, check the ECCN entry if you notice an ECCN. Then decide if the object meets ECCN parameters. If the ECCN has a list in the subparagraph(s) of “Objects.” Reading this subparagraph(s) is necessary. Moreover, to establish that the product complies with the technical requirements in the category ECCN. Before you find the right ECCN entry, you may have to check over one ECCN definition.

Request the Bureau of Industry and Defense

(BIS) for a standardized classification.

What if they do not list your product?

Check your CCL article carefully. Because they could designate it as EAR99 if your item does not match in with any ECCN variable. Moreover, notice that no other entity regulates it. If this is the case, the NLR licensing exception stating that they cannot export the goods, get a permit.

The conditions are as follows:

They do not submit the article to an endorsed location. Further, the products shall not be forwarded to an individual who is refused, sanctioned, or banned end-user. Finally, they do not use the component for higher controls for particular end-use.
